General Terms and Conditions of Sale and Use. This version replaces and supersedes the version of March 2025.

Language notice

This English text is a courtesy translation of the French Conditions Générales de Vente et d'Utilisation of CASA BOOST. Only the French version is legally binding. In the event of any discrepancy between the two texts, the French version prevails (Article 25.3).

Article 1

PURPOSE AND ACCEPTANCE

1.1 These General Terms and Conditions govern all relations between BE STUDIO SA, operating the CASA BOOST studio (hereinafter "CASA BOOST" or "the Studio"), and any person purchasing its services (hereinafter "the Client").

1.2 CASA BOOST provides physical training, movement and wellbeing services, together with food and beverage services at The Well Lab.

1.3Acceptance Every booking and every purchase of a class, package, membership or product, whether made through the BSport platform, on www.casa-boost.com or at the Studio, constitutes full and unreserved acceptance of these General Terms and Conditions in the version in force on the date of the transaction.

1.4 The version in force is permanently published on www.casa-boost.com and its date appears at the head of this document. The Client is invited to read it before any transaction. Previous versions are retained by CASA BOOST and provided on request.

1.5Information provided to the Client The booking, cancellation, absence and punctuality rules set out in Article 3 are brought to the Client's attention through three channels: an email sent on each purchase, a reminder included in every booking confirmation email, and permanent publication on www.casa-boost.com. The Client acknowledges having been duly informed accordingly.

Article 2

PRICES, PRODUCTS AND VALIDITY PERIODS

2.1Prices The applicable prices are those displayed on the BSport product page at the time of purchase. All prices are stated in Swiss francs (CHF), value added tax included.

2.2Nature of a credit A credit is personal and non-refundable. It may not be assigned to a third party, subject to the credit-sharing arrangement set out in Article 2.6.

2.3Price changes CASA BOOST reserves the right to amend its prices in line with changes in its costs, applicable taxation or its offering. Any change applies exclusively to purchases and renewals made after it takes effect. It affects neither packages nor memberships already acquired.

2.4Validity periods Each product carries its own validity period, stated on its BSport product page at the time of purchase and repeated in the purchase confirmation email.

That period runs from the date of purchase, with the exception of the Welcome Package, whose period of 14 consecutive days runs from the first class attended and which may be purchased only once per person.

Unlimited and Flex memberships are entered into for a fixed term and may not be terminated before that term expires, subject to Articles 4.2 and 4.5. The Monthly Unlimited renews automatically from month to month and is terminated in accordance with Article 2.7.

2.5Bonus packages and promotional offers Packages including bonus credits, in particular "10 classes + 1 bonus" and "15 classes + 3 bonus", together with any promotional offer, are governed by the conditions of the corresponding reference package, namely the 10-class package and the 15-class package respectively, in particular as regards validity period, credit sharing and fees. Any specific conditions are stated on the BSport product page at the time of purchase.

2.6Credit sharing — 5, 10 and 15-class packages The holder of a 5, 10 or 15-class package may book two or three places in the same class in order to share credits with one or two other participants. Sharing is conditional on the package holder actually attending the class concerned. It operates within the limit of the available balance. It does not apply to unlimited memberships. CASA BOOST takes no part in the relationship between the holder and the beneficiaries of the sharing.

2.7Termination of the Monthly Unlimited Notice of termination must reach hello@casa-boost.com no later than 5 days before the renewal date. Notice received after that deadline takes effect at the end of the following month, the month already begun remaining payable in full.

2.8Recovery of expired credits On expiry of a 1, 5, 10 or 15-class package, unused credits are forfeited. The Client may nevertheless recover all or part of those credits, at the Client's choice, on payment of CHF 12 per credit recovered. The request must be sent to hello@casa-boost.com no later than 30 days after the package expires. Recovered credits are valid for one (1) month from the date of recovery. The Client is under no obligation to recover any credit and may freely allow credits to expire.

2.9No right of withdrawal Purchases made online, on BSport or at the Studio carry no right of withdrawal, Swiss law providing for none in this field. Articles 40a et seq. of the Swiss Code of Obligations remain reserved for contracts concluded through doorstep selling away from CASA BOOST's premises.

2.10Payment default Where a monthly instalment of a Flex or Monthly Unlimited membership fails to be collected, CASA BOOST sends the Client a reminder by email. Failing settlement within 10 days, access to the Studio is suspended until payment is made, without that suspension extending the term of the membership. As Flex memberships are entered into for a fixed term, the instalments remaining until that term expires remain payable. Statutory default interest remains reserved.

Article 3

BOOKINGS, CANCELLATIONS, ABSENCES AND LATE ARRIVAL

This Article governs the entirety of the rules on booking, cancellation, absence and late arrival. No other provision of these General Terms and Conditions provides for any fee on those grounds.

3.1Booking Booking is compulsory, through the BSport platform, the website www.casa-boost.com or directly at the Studio.

3.2Confirmation of a class A class is confirmed once 3 registrations have been received.

3.3Cancellation by CASA BOOST CASA BOOST may cancel a class on a minimum of 1 hour 30 minutes' notice, in particular where the number of registrations is insufficient. In that event the credit is returned to the Client in full, no fee is due and no further compensation may be claimed.

3.4Cancellation deadline for the Client Cancellation is free of charge up to 9 hours before the start of the class, whatever product the Client holds. This deadline is notified to the Client in accordance with Article 1.5.

3.5Consequences of late cancellation, absence or late arrival

Bookings arising from the waiting list are subject to none of the consequences set out in the table above, in accordance with Article 6.2. The Welcome Package is governed by the specific regime of Article 3.7.

3.6Recovery of a credit Recovery of a credit forfeited under the table above is made on request sent to hello@casa-boost.com within 15 days following the class concerned, against payment of the stated amount. A recovered credit retains the original expiry date of the package.

3.7Welcome Package — single allowance The Welcome Package benefits from a single allowance. The first late cancellation or unnotified absence occurring during its term gives rise to no fee. The Client is informed of this by email and the rules of this Article are restated on that occasion. From the second occurrence onwards, the fees provided for in Article 3.5 for unlimited memberships apply, namely CHF 12 for a late cancellation and CHF 20 for an unnotified absence. The allowance is not renewable, the Welcome Package being available only once per person.

3.8Means of payment and collection of fees Registering a valid means of payment on BSport is a condition of booking for unlimited and Flex memberships. The fees provided for in Article 3.5 are collected automatically from that means of payment. Where collection is not possible, the fees remain payable. Their settlement is a condition of further bookings only once the total of unpaid fees reaches CHF 50, or once a second reminder has gone unanswered.

Registration of a means of payment is not required for the Welcome Package. Any fees due under Article 3.7 are settled at the Studio or online, their settlement being a condition of any further booking.

3.9 The fees provided for in this Article are independent of how full the class is.

3.10Sudden medical impediment The fees and forfeiture of credit provided for in this Article do not apply where the Client evidences, by medical certificate or any other supporting document, a sudden impediment arising after the cancellation deadline had passed. The request must be sent to hello@casa-boost.com within 15 days following the class concerned.

Article 4

SUSPENSION OF PACKAGES AND MEMBERSHIPS

4.1Principle Packages and memberships may not, as a rule, be suspended.

4.2Suspension on medical grounds A suspension is granted on production of a medical certificate attesting to an inability to practise the activity. The request, together with the certificate, must be sent to hello@casa-boost.com as soon as possible. The suspension takes effect on the date stated in the certificate and lasts for the period of incapacity attested. The validity period of the package or membership is extended by an equivalent period.

4.3Personal convenience No suspension is granted for reasons of personal convenience, in particular holidays, business travel or temporary absence from Geneva.

4.4 Any other request for exceptional suspension must be made in writing. It is a matter for CASA BOOST's discretion, with no guarantee of acceptance.

4.5Permanent incapacity Where a medical certificate attests to a permanent inability to practise the activities offered, the Client may request termination of the package or membership. Reimbursement covers only the unused portion, calculated as follows: for packages, by reference to unused credits, valued at the unit price actually paid per credit; for fixed-term memberships, by reference to the term remaining as from the date of the certificate. Any fees due under Article 3 remain acquired by CASA BOOST.

Article 5

REFUNDS

Subject to Articles 2.10, 3.3, 3.10, 4.2, 4.5, 13.1, 13.2, 19, 22.3 and 24, no refund, deferral or credit note is granted for a service not used, whatever the cause, including illness, accident or a change in personal or professional circumstances.

Article 6

WAITING LIST

6.1 Registration from the waiting list is automatic up to 1 hour before the start of the class. The Client is informed by notification.

6.2No financial consequence Bookings arising from the waiting list are subject to none of the consequences provided for in Article 3.5. A Client who, for whatever reason, is unable to attend a class for which they were registered from the waiting list suffers neither forfeiture of credit nor any fee, whether they hold a package or an unlimited membership.

6.3Cancelling out A Client who is unable to attend must nevertheless cancel their registration as soon as they become aware of this, so as to release the place for other Clients.

6.4Misuse CASA BOOST reserves the right to restrict waiting-list access for a Client whose repeated absences from waiting-list bookings deprive other Clients of a place.

Article 7

PUNCTUALITY AND CLOSING OF THE DOORS

7.1 Clients are advised to arrive at least 10 minutes before the start of the class.

7.2 The doors close strictly at the start time of the class. No late entry is permitted, without exception and without any grace period. This rule serves a safety requirement, entry during a session presenting a risk both to the late participant and to the other participants, as well as a requirement of respect for the group and for the conduct of the session.

7.3 Arrival after the doors have closed is treated as an unnotified absence and entails the consequences provided for in Article 3.5.

Article 8

CHANGES TO THE OFFERING AND THE TIMETABLE

8.1 CASA BOOST reserves the right to change timetables, the composition of the class offering and the allocation of coaches. Occasional changes give rise to no compensation.

8.2 In the event of a substantial and lasting reduction in the offering significantly affecting the value of a current membership, the Client may request a proportionate extension of the validity period of that membership.

Article 9

ACCESS TO THE STUDIO, AGE AND RULES OF USE

9.1Attire Appropriate sportswear is compulsory.

9.2Minimum age Subject to Article 9.3, access to the Studio is reserved to persons aged 16 or over. CASA BOOST does not admit children as Clients and offers no activity intended for children.

9.3Mom&Baby classes — exception By way of exception to Article 9.2, Mom&Baby classes are open to a parent accompanied by their infant, within the age limits stated on the class page.

The infant is not a Client and does not take part in the class. The infant remains under the exclusive and continuous responsibility of the parent present, throughout the whole of the infant's presence at the Studio, including in the changing rooms and common areas.

CASA BOOST provides no childcare and no supervision of the infant. The parent is liable for any damage their infant may cause.

Only one infant is admitted per parent. The parent must be registered for the class.

9.4Persons aged 16 to 18 Persons aged 16 or over and under 18 may not open an account, purchase a package or membership, or make a booking in their own name.

Their participation is possible only in classes held in the Inspire room, to the exclusion of ReBoost, Boost Fitness and any other activity offered by CASA BOOST, and on the following cumulative conditions:

  • the legal guardian is themselves a Client of CASA BOOST;
  • the legal guardian purchases the product, makes the booking from their own account and pays the price;
  • the legal guardian is registered for and present at the same class;
  • the legal guardian remains solely responsible for the minor throughout the whole of the minor's presence at the Studio, including in the changing rooms and common areas.

By making the booking, the legal guardian accepts these General Terms and Conditions for themselves and for the minor, expressly authorises the minor's participation and declares that there is no medical contraindication to it. The legal guardian is liable for the financial obligations and for any damage arising from that participation.

9.5Conditions of access Access to the Studio is reserved to Clients holding an active membership or a valid credit.

9.6Refusal of access and exclusion CASA BOOST reserves the right to refuse access to, or to exclude, any Client who breaches these General Terms and Conditions, disturbs order within the Studio, behaves inappropriately, shows disrespect or aggression towards staff or other Clients, commits fraud, or damages the reputation of CASA BOOST. In the event of serious misconduct, in particular assault, threats, harassment, fraud or intentional damage, CASA BOOST may terminate the membership or package with immediate effect, without refund or compensation. In other cases of repeated breach, termination gives rise to reimbursement of the unused portion, calculated in accordance with Article 4.5.

9.7Use of equipment Equipment may be used only in accordance with staff instructions. CASA BOOST accepts no liability for any incident resulting from non-compliant or unsupervised use.

9.8House rules The Client complies with the house rules displayed at the Studio and with staff instructions, which supplement these General Terms and Conditions.

9.9Damage to equipment Any damage caused intentionally or through gross negligence to equipment may be charged to the Client at the cost of repair or replacement.

Article 10

HEALTH AND SAFETY

10.1Fitness to participate Every Client is advised to consult a doctor before beginning any activity, in particular women who are pregnant or in the post-partum period, persons with epilepsy and persons prone to claustrophobia, the ReBoost room being fitted with neon lighting.

10.2Client's responsibility The Client is solely responsible for assessing their state of health and physical condition. It is for the Client to inform staff of any pre-existing condition liable to have a bearing on their participation.

10.3Inherent risks The Client acknowledges that physical activity carries inherent risks, in particular muscle injury, fracture and cardiac complications, and declares that they take part in classes at their own responsibility.

10.4Limitation of liability CASA BOOST cannot be held liable for injuries, accidents or medical complications occurring during classes, save in the event of wilful misconduct or gross negligence on its part. CASA BOOST, its officers, employees and partners are not liable for indirect or consequential loss, including loss of profit, save in the event of wilful misconduct or gross negligence.

10.5No medical supervision CASA BOOST provides no medical supervision of its Clients. In the event of an incident, the staff present alert the emergency services without delay.

Article 11

ACTIVITIES AWAY FROM THE STUDIO

CASA BOOST cannot be held liable for incidents or accidents occurring during activities organised away from the Studio, in particular running sessions and outdoor training, save where at fault. The Client remains bound to comply with traffic rules and with the coach's instructions.

Article 12

DISPUTES BETWEEN CLIENTS

CASA BOOST is not liable for disputes arising between Clients. Any inappropriate behaviour must be reported to staff, who decide at their discretion what action to take.

Article 13

FORCE MAJEURE AND TEMPORARY CLOSURES

13.1Force majeure In the event of force majeure, in particular a pandemic, natural disaster, fire, restriction imposed by the authorities, strike or network failure, CASA BOOST takes measures appropriate to the situation. Its liability cannot be engaged by reason of the interruption of services and no refund is due on that ground. However, where the interruption exceeds seven (7) consecutive days, the validity period of current packages and memberships is extended by a period equivalent to that of the interruption.

13.2Temporary closures No refund is due in the event of temporary closure for works, maintenance or an exceptional event. However, where the closure exceeds seven (7) consecutive days, the validity period of current packages and memberships is extended by a period equivalent to that of the closure.

Article 14

INSURANCE AND PERSONAL BELONGINGS

14.1 CASA BOOST carries public liability insurance covering damage caused by its premises or its staff where at fault.

14.2 CASA BOOST accepts no liability for the loss, theft or damage of personal belongings, including in the changing rooms and common areas. Clients are advised not to bring valuables. Lockers are made available without any guarantee of security.

Article 15

ELECTRONIC COMMUNICATIONS

Exchanges taking place through the BSport platform and by email are deemed secure to the extent of usual standards. The Client accepts the risks inherent in electronic communication.

Article 16

DATA PROTECTION

16.1Controller BE STUDIO SA, Rue du 31 Décembre 23, 1207 Geneva.

16.2Data processed Identity and contact details, booking and attendance data, payment data, together with information voluntarily provided by the Client, in particular of a medical nature, for the purposes of safe participation. Health data constitutes sensitive personal data within the meaning of the Federal Act on Data Protection. It is processed only with the Client's express consent and solely for the purposes of safe participation.

16.3Purposes Performance of the contract, management of bookings and payments, participant safety, information and marketing communications, and compliance with legal and accounting obligations.

16.4Recipients Data is processed by CASA BOOST and by its processors, in particular the booking platform BSport and the payment provider. It is not transferred to any third party for commercial purposes.

16.5Transfers abroad Certain processors are established outside Switzerland. Transfers take place only to states affording an adequate level of protection or on the basis of recognised contractual safeguards.

16.6Retention period For the duration of the contractual relationship, and thereafter for the applicable statutory retention periods.

16.7Client's rights The Client has the right of access, rectification, erasure, objection to processing for marketing purposes and data portability. Any request should be sent to hello@casa-boost.com.

16.8Marketing communications The Client may unsubscribe from marketing communications at any time using the link included in every message.

Article 17

GENERAL LIABILITY

Subject to the mandatory provisions of Swiss law, CASA BOOST accepts no liability, save in the event of wilful misconduct or gross negligence.

Article 18

INTELLECTUAL PROPERTY AND IMAGE RIGHTS

18.1Intellectual property All content produced by CASA BOOST, in particular its methods, programmes, materials, trade marks and audiovisual content, remains its exclusive property.

18.2Image rights CASA BOOST may take photographs and videos within the Studio and at its events. Use of a Client's image for communication and promotional purposes is subject to that Client's express consent, obtained on registration through BSport or in any other written form. That consent is freely given, specific and revocable at any time, without justification, by simple request to hello@casa-boost.com. Revocation entails the withdrawal of the content concerned from media controlled by CASA BOOST within a reasonable period. A Client who does not wish to appear in a photograph or recording may inform the coach before the class.

Article 19

POP-UP STORE AND RETURNS

19.1 Items purchased at the pop-up store may be returned within 30 days of the date of purchase, on production of the receipt, provided they are in perfect condition, unused and bearing their original label.

19.2 Sale and promotional items are excluded from return and exchange, as are wellbeing and hygiene accessories, in particular water bottles, yoga mats and recovery equipment, for reasons of hygiene.

19.3 Gift cards are not refundable in cash. Their validity period is twenty-four (24) months from issue, unless otherwise stated on the card.

19.4 CASA BOOST reserves the right to refuse any return not meeting the above conditions.

19.5 The above provisions govern returns for convenience. They do not affect the Client's rights under the statutory warranty for defects.

Article 20

THE WELL LAB

20.1 CASA BOOST reserves the right to change The Well Lab menu and offering without notice.

20.2Allergens In accordance with Swiss food legislation, information on allergens present in the products offered is available from staff on request. A Client suffering from an allergy or intolerance must inform staff before ordering and check the composition of the products.

20.3 Subject to CASA BOOST complying with its statutory information obligations, its liability cannot be engaged by reason of the consequences of an allergy or intolerance that has not been notified to it.

20.4 Mandatory provisions on product liability remain reserved.

Article 21

MEDIATION

Any dispute shall first be the subject of an attempt at mediation in Geneva. This clause does not prevent either party from bringing proceedings before the competent courts.

Article 22

AMENDMENT OF THESE TERMS AND CONDITIONS

22.1 CASA BOOST reserves the right to amend these General Terms and Conditions. Any amendment is published on www.casa-boost.com stating the date on which it takes effect.

22.2 Amendments relating to prices, validity periods and financial conditions apply exclusively to purchases and renewals made after they take effect. They do not affect packages and memberships already acquired, which remain governed by the conditions in force on the date of their purchase.

22.3 Amendments relating to the rules on booking, cancellation, punctuality and access to the Studio apply to all Clients on expiry of a period of 30 days from their notification by email.

22.4 Where an amendment made under the preceding paragraph is materially unfavourable to the Client, the Client may, within 30 days of notification, terminate their package or membership and obtain reimbursement of the unused portion, calculated in accordance with Article 4.5.

Article 23

GOVERNING LAW AND JURISDICTION

Swiss law applies exclusively. The courts of Geneva have jurisdiction, subject to the mandatory places of jurisdiction provided for by law, in particular in respect of contracts concluded with consumers.

Article 24

SPECIAL EVENTS

24.1 Where CASA BOOST cancels a special event, in particular a workshop, masterclass or themed evening, the amount paid is refunded in full.

24.2 Where the Client cancels, no refund is granted, save in a case of force majeure evidenced by official documentation.

24.3 In respect of events organised away from the Studio or in partnership, CASA BOOST is liable for incidents or damage only where at fault.

Article 25

FINAL PROVISIONS

25.1 Should any provision of these General Terms and Conditions be declared void or unenforceable, the remaining provisions retain their full validity. The provision concerned shall be replaced by a valid provision whose economic effect comes closest to that intended.

25.2Transfer CASA BOOST may transfer these General Terms and Conditions and any current contracts to any company taking over all or part of its business, in particular in the event of a restructuring, merger or sale of the business. The Client's rights remain unchanged.

25.3 These General Terms and Conditions are drawn up in French. Any translation is provided for information only. In the event of any discrepancy, the French version prevails.
